Delays in Court Cases

There are problems in multiple areas, but the incumbent refuses to acknowledge this is partly a prosecution problem. One of the drivers of continuances is the prosecutions failure to turn over evidence.

Many cases were previously delayed when, instead of either turning over evidence or indicating it was unavailable, the office argued that the defendant had no right to discovery before preliminary hearing. This assertion was proven wrong by an appellate court ruling against another county that tried the same argument.

Also, people with very large caseloads of less serious cases combined with very serious cases can prioritize the serious cases but must still be competent on each case. Having a group of prosecutor focusing on serious cases is vital.
